RESIDENCE PERMIT 

(WORK, STUDY, FAMILY REUNIFICATION, VISIT, ETC. FOR MORE THAN 90 DAYS)

 

STARTING 15 AUGUST 2022 applications are to be lodged at the VFS Visa Application Center in person where an interview takes place and biometrics are taken. (Applications submitted through the online site "Enter Hungary" will continue to be handled by the Consulate.)

The physical address is: 2305, Ecoplaza Building, Don Chino Roces Ave, Ext, Makati, 1231 Metro Manila, Philippines.

The applications are sent to and assessed by the Consulate of Hungary in Manila and transmitted to the Hungarian Immigration, if all documents are in order and complete. The processing time of the Immigration is between 1-4 months depending on the workload. You will be notified about the decision by e-mail. Please be advised that during this time the VFS or the Consulate have no access to your case and thus will not be able to give answer to enquiries regarding state or outcome of the procedure.

Resident DIPLOMATS or embassy personnel should apply directly at the Consulate. Please request an appointment by sending an email (consulate.mnl@mfa.gov.hu) with your contact details, planned travel date, passport copy and the copy of the Verbal Note about your assignment sent to the Consular Department of the Ministry of Foreign Affairs and Trade of Hungary. Once the Ministry confirms your assignment we will schedule you ASAP.

 

General checklist for all residency permit applications

  • passport with 18 months validity. Please note that the validity of the residency permit cannot be longer than 3 months before the expiry of your passport. It should be machine-readable, contain at least two blank pages and should not be older than 10 years;
  • one recent passport-size photo. Please note that the photos have to be color and all facial details are clearly visible, including ears. Glasses, masks, hats are not allowed.
  • residence permit handling fee to be paid at the VFS;
  • please note if your application requires the authentication of Power of Attorney or translation you have to make a separate appointment with the Consulate by email (consulate.mnl@mfa.gov.hu) and pay a separate fee;
  • specific supporting documents according to the purpose of travel (see the following section);
  • duly signed authorization if you would like to allow us to communicate with your Hungarian and/or local company/lawyer or family member.

Documents checklist for the main residency types

1. Work/employment

  • signed preliminary work contractindicating at least company name, name and signature of the duly authorized representative of the company, employee name and signature and personal data, duration of contract, position, salary, place of work (“előzetes megállapodás”);
  • employer’s declaration on the benefits provided to the employee, if any (ie. accommodation, meal, plane ticket, travel in Hungary, provision for subsistence for the first month, etc.);
  • proof of accommodation (excerpt from the land registry, owner’s agreement, contract of lease, hotel booking);
  • valid certificate of permission to employ a foreigner (igazolás munkaerőigény bejelentéséről) or proof of exemption to obtain the “igazolás”;
  • details of the contact person at the employer (name, position, e-mail, telephone);
  • details of the contact person at the Philippine and the Hungarian manpower agency, if any;
  • proof of the applicant’s qualifications (diplomas, trainings, certificates from previous employers), language skills, similar job experience(s);
  • resume.

Please note, that once the applicant has the visa, a POEA travel clearance has to be obtained from the Philippines Overseas Employment Administration (www.poea.gov.ph). Most cases the POEA requires processing the clearance through a licensed agency (http://www.poea.gov.ph/services/recruiters.html).

 

2. Study

  • certificate of admission to the educational institute, including confirmation of completed payment of tuition and other fees (or tuition fee waiver);
  • certification of award (in case of scholarship);
  • proof of the applicant’s qualifications (diplomas, certificates) with Apostille authentication (to be obtained from Department of Foreign Affairs of the Philippines, Authentication Division);
  • proof of language skills;
  • resume;
  • proof of sufficient resources to cover means of subsistence in Hungary (own or family member’s income or assets for tuition fee, accommodation, return travel, healthcare). According to Hungarian law, only close family members can provide financial assistance for studies that is spouses, parents, grandparents and siblings (valid marriage, birth, etc. certificates are to be presented). The Immigration Office will not accept assistance from uncles, nieces, friends, colleagues. In case of company or educational institute providing for finance, a valid contract has to be submitted. Documents can be:
    • a certificate on the payment of scholarship grant,
    • funds held on bank accounts, etc.
    • In case of affidavit of support or contract, proof of ability to provide support shall be enclosed (6 months bank history, employer’s certificate with position and salary);
  • proof of accommodation (ie. lease agreement, or dormitory acceptance letter, etc.);
  • proof of health care (provided by the school or insurance company);
  • sufficient funds to finance a two way flight.
  • for Stipendium Hungaricum (www.stipendiumhungaricum.hu) students visa, tuition, insurance fee is waived, support for accommodation and daily living is provided, amount of needed own funds can be much less. However the VFS service fee is still applicable.

3. Family reunification

The Immigration of Hungary will examine if the partners involved are misusing of the right to family reunification such as marriages contracted for the purpose to acquire right to residency (marriage of convenience, registered partnership of convenience), fake adoption or declaration of fathership to convey nationality and a right of residence on the child and its mother, knowing that he is not its father and not willing to assume parental responsibilities. In this regard the Consulate and the Immigration of Hungary reserves the right to conduct an interview at the Consulate after the submission of the application to clarify the situation.

Checklist:

  • Hungarian birth/marriage/adoption certificate for family member of a Hungarian citizen;
  • national birth/marriage/adoption certificate if the family member residing in Hungary is not Hungarian;
  • in case of foreigner national family member with the right of residence in Hungary: copy of the residence permit;
  • proof of means of subsistence in Hungary, to substantiate that the lawful income or assets can cover the living expenses of the family, including accommodation, daily living, return travel; Documents can be:
    • a notarized statement made by the family member providing support to the applicant;
    • proof of the family member’s ability to provide such support (6 months bank history, employers certificate with salary, latest income certificate issued by the tax authority for the family member and/or for the applicant);
  • proof of Hungarian accommodation:
    • a notarized or two witness statement by the owner of the accomodation or;
    • proof of ownership with the excerpt from the real estate registry (minimum 6 square meters of living space per person) or a commercial or other accommodation, lease contract, courtesy accommodation;
    • a real estate sales contract and a copy of the decision of the competent Budapest or county government agency granting permission for the acquisition of a real estate property;
  • proof of comprehensive health insurance: with the social security system or with private insurance company or a declaration and sufficient funds to finance it;

4. Visit

Checklist:

If you wish to extend your residency permit you can only do that in Hungary at the nearest Immigration Office. If your permit is expired and you are in the Philippines, you need to apply for a new permit by initiating a new application procedure at the VFS.

Please be advised that individual circumstances can vary to a large extend, so the Consulate or the Immigration Office reserves the right to request further documents to be submitted or to conduct an interview at the Consulate after the submission of the application to clarify the situation.

PLEASE BEAR IN MIND THAT BECAUSE OF THE THREAT OF ILLEGAL MIGRATION AND TRAFFICKING OF PERSONS, ALL AUTHORITIES DURING THE VISA PROCEDURE ARE CLOSELY OBSERVING AND MONITORING WHETHER THE EMPLOYMENT, STUDY OR THE FAMILY RELATIONSHIP HAS BEEN ESTABILISHED ONLY TO OBTAIN A RESIDENCY PERMIT. IN CASE OF ABUSE OR FRAUD THE APPLICATION WILL BE REFUSED AND CRIMINAL AND/OR IMMIGRATION SANCTIONS WILL BE APPLIED.
